Protection of Personal Data (KVKK)

Data Controller: As KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş., we attach great importance to the confidentiality and security of your personal data. Through this Privacy Notice, in our capacity as Data Controller, we wish to inform you about the processing of your personal data in accordance with the applicable legislation, primarily the Law on the Protection of Personal Data No. 6698 ("KVKK") and the Law on the Regulation of Electronic Commerce No. 6563 ("E-Commerce Law"). The personal data we process, our purposes, and the legal grounds

Your identity data (name, surname), contact data (mobile phone number, e-mail address), and transaction security data (consent records, IP address, pixel tags, click-stream, traffic data) are processed under KVKK Art. 5/2, based on the legal grounds that (i) it is explicitly provided for by law, (ii) it is directly related to the establishment or performance of a contract, and (iii) it is mandatory for the establishment, exercise, or protection of a right — for the purposes of providing you with an offer suited to your request, communicating with you, carrying out sales and marketing activities, and fulfilling administrative/legal obligations.

Where you have given your explicit consent, your data may also be processed for the purposes of identifying potential buyers/tenants and targeted marketing, commercial strategy and customer satisfaction studies, promotional and marketing communications via phone/SMS/e-mail and digital channels within the scope of your consent, and statistical studies.

Transfer

In accordance with the fundamental principles of the KVKK and Articles 8–9, and where your explicit consent exists, your personal data may be transferred to our domestic/international suppliers, service providers, and business partners from whom we receive services/consultancy and who are subject to confidentiality obligations, and to legally authorized public institutions and organizations.

Your rights

Under KVKK Art. 11, you have the right to access your data, to learn whether it has been processed, to request its correction/deletion, and to object to its processing.

Personal Data Protection Policy

Purpose of the Personal Data Protection Policy

This Personal Data Protection Policy ("Policy") sets out the approach of KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş to the protection of personal data, and defines the following terms:

Processing and Transfer Permission

Domestic Processing and Transfer: The processing of Data Subjects' Personal Data domestically and its transfer to third parties by KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş. is possible with the Data Subject's explicit consent; in the absence of explicit consent, it will only take place under the following conditions:

It is explicitly provided for by law;
It is mandatory for the protection of the life or physical integrity of the person concerned or of another person, where the person concerned is physically incapable of giving consent or their consent is not legally valid;
It is directly related to the establishment or performance of a contract, provided it is necessary to process the personal data of the parties to that contract;

Processing and Transfer of Special Category Personal Data: The processing and transfer of special category Personal Data is only possible with the explicit consent of the persons concerned; in the absence of explicit consent, it will only take place under the following conditions:

Personal Data not relating to health and sexual life may be processed without seeking the explicit consent of the person concerned in cases stipulated by law.
Personal Data relating to health and sexual life may only be processed, without seeking the explicit consent of the person concerned, by persons bound by a duty of confidentiality or authorized institutions and organizations, for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of healthcare services and their financing.

Processing and Transfer Abroad: In connection with its business partners and employees, the processing of Data Subjects' Personal Data domestically and its transfer to third parties by KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş. is possible with the Data Subject's explicit consent; in the absence of explicit consent, it will only take place where, in addition to the conditions set out above, in the foreign country to which the Personal Data will be transferred:

Adequate protection exists, as determined and announced by the Board;
Where adequate protection does not exist, the data controllers in Turkey and in the relevant foreign country undertake in writing to provide adequate protection, and the Board has granted permission.

Personal Data may also be transferred abroad, subject to the provisions of international agreements, in cases where the interests of the country or of the person concerned would be seriously harmed, but only with the Board's permission after obtaining the opinion of the relevant public institution or organization.

Changes to the Personal Data Protection Policy

KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş. may make changes to this Policy from time to time as required by its activities or by law. Your Personal Data Processed, Purposes of Processing, and Legal Grounds

Your identity data (name, surname), contact data (mobile phone number, e-mail address), and location and transaction security data (your consent records, IP address, pixel tags, click-stream, traffic data) will be processed by our Company under KVKK Art. 5/2, based on the legal grounds that (i) "it is explicitly provided for by law", (ii) "it is directly related to the establishment or performance of a contract, provided it is necessary to process the personal data of the parties to that contract", and (iii) "it is mandatory for the establishment, exercise, or protection of a right", for the purposes set out below:

Where you request a product/service in connection with the real estate assets in our Company's portfolio, carrying out the work necessary to make you an offer, transfer information appropriate to your request, and fulfil your request, and communicating with you in this context,
Enabling our Company to fulfil its administrative and legal obligations under all applicable legal regulations,
Conducting our relations with our Company, our affiliates, our business partners, and third parties with whom we have a business relationship, ensuring the legal and commercial security of such persons, following legal proceedings, and establishing, exercising, and protecting rights arising from legislation.

Where your explicit consent exists under KVKK Art. 5/1, your collected personal data may also be processed by our Company for the purposes set out below:

Identifying customers who may be potential buyers/tenants in respect of the real estate assets in our Company's portfolio, and carrying out targeted marketing activities in respect of such customers,
Determining our Company's commercial and business strategies, conducting our customer services/relations and evaluating your satisfaction, and carrying out statistical studies in this context,
Where you have given your consent, contacting you in any manner in connection with the real estate assets in our Company's portfolio through your contact information, and providing information for promotional and marketing purposes and transferring data and information via telephone, SMS (text message), e-mail, and digital channels,
Keeping statistics relating to customers in order to increase efficiency in sales, marketing, and customer services.

Parties to Whom Your Personal Data Is Transferred and the Purposes of Transfer

Your personal data processed by KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş. may, in accordance with the fundamental principles set out in the KVKK and pursuant to KVKK Art. 8/1, where your explicit consent exists and is required for the purposes set out above, be transferred to persons and institutions, suppliers, service providers, and business partners resident domestically from whom our Company receives services and/or consultancy for the provision of its services and products or for the performance of a contract, and who are subject to confidentiality obligations. In addition, within the scope of the activities described above, your personal data may be transferred to legally authorized public institutions and authorized private persons pursuant to KVKK Art. 8/2. Furthermore, in order to achieve the purposes set out above, pursuant to KVKK Art. 8/1, where your explicit consent exists, your data may be shared with KO MİMARLIK ENDÜSTRİYEL ÜRÜN TASARIM PROJE İNŞAAT TAAHHÜT A.Ş., and pursuant to KVKK Art. 9/1, where your explicit consent exists, with our business partners and suppliers resident abroad from whom we receive services under a contract and who are subject to confidentiality obligations.
